Terms and Conditions
EFFECTIVE FROM 20.11.2017
These General Terms and Conditions (“Terms”) govern the relationship between Terrigal Pacific Hotel Pty Ltd (ABN 76 609 479 852) (“We”, “Us”, “Our”) and the member (“You”, “Your”) regarding Your membership of Aqueous Health Club.
We reserve the right to amend these Terms on 30 days’ notice to You. We may choose to post notice of changes to the Terms in the Aqueous Health Club or on our website. If an amendment adversely affects You, You may cancel Your membership by written notice to us within 30 days of when the change takes effect, and receive a pro rata refund of any prepaid fees.
If You wish to suspend Your membership, You must, prior to the period of suspension, complete and submit the suspension form. For a 12 month membership, the minimum suspension period is 1 week and the maximum suspension period is 5 weeks. For a 6 month membership the minimum suspension period is 1 week and the maximum suspension period is 2 weeks.
On occasion where the hotel has been booked for a private use event, Your membership will be suspended by the hotel for the duration and access will not be available. In this situation, we will compensate you by adding the number of missed days to the end of your contracted term.
There is a seven day cooling off period in which to submit a cancellation for Your membership. The cooling off period commences on the date You sign these Terms. Any refund You request must be in writing and presented during the cooling off period.
Membership cards are not transferable and must be used only by You. Identification cards are mandatory. You must have a valid membership card with You each time You use the Aqueous Health Club facilities to be permitted entry. Your membership is not transferable. If Your membership card is used by another member or a non member (including family and children), we may suspend or terminate Your membership. In such case no refund of your membership fee will be paid.
Lost/stolen membership cards must be reported immediately. A replacement membership card can be arranged for $10 fee.
You agree to abide by the rules set by Us (located on the walls of pool area and weights room) in relation to the use of the Aqueous Health Club facilities, to conduct Yourself appropriately towards all members, hotel guests and staff and follow the reasonable directions of Us and Our staff whilst You are on or about the premises. You acknowledge that if You fail to comply with any such rules or directions or otherwise engage in behaviours which are offensive or disruptive to Us, other members or hotel guests, that You may be asked to leave the premises. If such behaviour continues, we may suspend or terminate your membership. No refund of your membership fee will be paid.
You are aware that Your use of the Aqueous Health Club and its facilities are completely unsupervised and are at Your own risk and may involve strenuous activity and special risk associated with such use. You release Us from all liability and responsibility for personal injury, property damage or death, except where You have suffered damage or loss caused by Our gross negligence.
These Terms constitute the whole agreement between You and Us and replace all previous agreements, communications and understandings between You and Us regarding Aqueous Health Club or its membership.
